Used Car Loan Rate Promise Terms and Conditions

We want you to be confident you’re receiving the lowest finance rate when you finance your used car with a lender through Driva. Subject to these Terms and Conditions and the Eligibility Criteria set out below, if after receiving a pre-qualified offer for a used car loan from Driva, you receive a pre-approval with a lower annual percentage rate (APR) from another website, we will find you a matching APR and give you a $300 fuel voucher. If we can’t, we’ll give you a $300 fuel voucher, obligation free.

The following terms and conditions relate to Driva’s “Used Car Loan Rate Promise” promotion (Promotion). By participating in the Promotion, you agree to these Terms and Conditions, as well as Driva’s website terms and conditions and privacy policy and consent. If we amend these Terms and Conditions, any changes will be posted on the Driva website at https://driva.com.au/ and will be effective from that time. Claims will be processed in accordance with the Terms and Conditions in effect on the date the claim is made.

In these Terms and Conditions, references to “we”, “us”, “our” or “Driva” refers to Driva Pty Ltd ABN 37 636 659 160.

1. Eligibility Criteria

1.1 To be eligible for the Promotion, you must meet the following criteria (Eligibility Criteria):

(a) receive your pre-qualified rate offer from Driva prior to commencing your application for the Competing Offer (defined below);

(b) submit your claim in accordance with the claim process detailed in paragraph 2.1 below;

(c) be the primary borrower on both loans; and

(d) if requested, demonstrate that you have provided the same information to Driva as you submitted to obtain the Competing Offer.

1.2 A ‘Competing Offer’ means a used car loan from a different website at the time you requested the pre-qualified rates for a used car loan on the Driva Website (Driva Loan):

(a) for which you have received a pre-approval;

(b) that has a lower APR than the Driva Loan;

(c) that has the same loan term as the Driva Loan;

(d) that has the same rate type (fixed, variable or other) as the Driva Loan; and

(e) that has the same repayment rate type (principal and interest versus interest only) as the Driva Loan.

2. Making a claim

2.1 To make a claim for the Promotion, you must:

(a) complete and submit the claim to contact@driva.com.au within 14 days of receiving your interest rate offer from one or more of the lenders on the Driva website; and

(b) email contact@driva.com.au proof of pre-approval for the Competing Offer.

2.2 Upon review of your claim, we will contact you notifying whether we can match the APR or otherwise arrange for you to be provided with a $300 fuel voucher.

3. Term and termination

3.1 This Promotion is available for any quote received from Driva.

3.2 We reserve the right to modify, suspend or terminate this Promotion or the Eligibility Criteria at any time and for any reason, without prior notice.

4. Liability

4.1 Our decisions in relation to any aspects of the Promotion are final and binding and no correspondence will be entered into.

4.2 We reserve the right, in our sole discretion, to confirm that you meet the Eligibility Criteria or the validity of any claim and to refuse the Promotion to any person we reasonably believe does not meet the Eligibility Criteria, or whose claim we cannot validate to our reasonable satisfaction, or is otherwise in breach of these Terms and Conditions.

4.3 To the maximum extent permitted by law, we are not responsible or liable for any loss or damage you may suffer (including, without limitation, loss of opportunity) whether direct, indirect, special, or consequential, in relation to the Promotion or you attempting to secure the Promotion.

5. Privacy

5.1 Where we collect personal information from or about you in connection with this Promotion, you agree that we may use or disclose it for the purposes of managing the Promotion and to market goods and services to you.

5.2 If you do not provide personal information requested of you in connection with this Promotion, we may not be able to accept your claim.

5.3 Our Privacy Policy contains information about how you may access the personal information we hold about you, how you may request the correction of that information and how you may lodge a complaint about a breach of the Australian Privacy Principles and how we deal with a complaint.
