Best Rate Promise Terms and Conditions

The following terms and conditions relate to Driva’s “Best Rate Promise” promotion (Promotion). By participating in the Promotion, you agree to these Terms and Conditions, as well as Driva’s website terms and conditions and privacy policy and consent. If we amend these Terms and Conditions, any changes will be posted on the Driva website at https://www.driva.com.au/legal/ for Australia and https://www.driva.co.nz/legal/ for New Zealand and will be effective from that time. Claims will be processed in accordance with the Terms and Conditions in effect on the date the claim is made. In these Terms and Conditions, references to “we”, “us”, “our”, or “Driva” refers toDriva Pty Ltd (ABN 37 636 659 160) and Driva New Zealand Limited (NZBN 9429051686994/Registered Company 8975050).

A. Used Car Loan

1. Eligibility Criteria

To be eligible for the Promotion, you must meet the following criteria (Eligibility Criteria):
(a) receive your pre-qualified rate offer from Driva prior to commencing your application for the Competing Offer (defined below);
(b) submit your claim in accordance with the claim process detailed in paragraph 2.1 below;
(c) be the primary borrower on both loans; and
(d) if requested, demonstrate that you have provided the same information to Driva as you submitted to obtain the Competing Offer.
A 'Competing Offer' means a used car loan from a different website at the time you requested the pre-qualified rates for a used car loan on the Driva Website (Driva Loan):
(a) for which you have received a pre-approval;
(b) that has a lower Comparison Rate than the Driva Loan;
(c) that has the same loan term as the Driva Loan;
(d) that has the same rate type (fixed, variable or other) as the Driva Loan; and
(e) that has the same repayment rate type (principal and interest versus interest only) as the Driva Loan.

2. Making a Claim

To make a claim for the Promotion, you must:
(a) complete and submit the claim to contact@driva.com.au within 14 days of receiving your interest rate offer from one or more of the lenders on the Driva website; and
(b) email contact@driva.com.au proof of pre-approval for the Competing Offer
Upon review of your claim, we will contact you notifying you whether we can match the Comparison Rate and arrange for you to be provided with a fuel voucher issued via Prezzee for the amount listed on Driva’s website. Read Prezzee's Fuel Gift Card T&Cs here.

3. Term and termination

This Promotion is available for any quote received from Driva.
We reserve the right to modify, suspend or terminate this Promotion or the Eligibility Criteria at any time and for any reason, without prior notice.

4. Liability

Our decisions in relation to any aspects of the Promotion are final and binding and no correspondence will be entered into.
We reserve the right, in our sole discretion, to confirm that you meet the Eligibility Criteria or the validity of any claim and to refuse the Promotion to any person we reasonably believe does not meet the Eligibility Criteria, or whose claim we cannot validate to our reasonable satisfaction, or is otherwise in breach of these Terms and Conditions.
To the maximum extent permitted by law, we are not responsible or liable for any loss or damage you may suffer (including, without limitation, loss of opportunity) whether direct, indirect, special, or consequential, in relation to the Promotion or you attempting to secure the Promotion.

B. Personal Loan

1. Eligibility Criteria

To be eligible for the Promotion, you must meet the following criteria (Eligibility Criteria):
(a) receive your pre-qualified rate offer from Driva prior to commencing your application for the Competing Offer (defined below);
(b) submit your claim in accordance with the claim process detailed in paragraph 2.1 below;
(c) be the primary borrower on both loans; and (d) if requested, demonstrate that you have provided the same information to Driva as you submitted to obtain the Competing Offer.
A 'Competing Offer' means a personal loan from a different website at the time you requested the pre-qualified rates for a personal loan on the Driva Website (Driva Loan):
(a) For which you have received a pre-approval.
(b) That has a lower Comparison Rate than the Driva Loan.
(c) That has the same loan term as the Driva Loan.
(d) That is an unsecured loan only.
(e) That has the same rate type (fixed, variable or other) as the Driva Loan.
(f) That has the same repayment rate type (principal and interest versus interest only) as the Driva Loan.

2. Making a Claim

To make a claim for the Promotion, you must:
